We reserve the right to delete your profile and membership if we believe you are not agreeing to our Terms.

As a pre-requisite to using our site and its services, you are required to register to our site using your valid email address and provide other important personal information about you such as your name, date of birth, gender, home town etc. While providing all such information, you agree to provide us with complete, current and accurate information. Failure to do so shall constitute a breach of our Terms of Use and may result in immediate termination of your account. You may not misrepresent any information with intention to impersonate a person, use a name subject to rights of a person other than you without appropriate authorization or provide information that is offensive, vulgar or obscene. We reserve the right to refuse registration or cancel your account at our sole discretion. You shall be responsible for maintaining the confidentially of your Igotdinged password.

   4. User Conduct

You understand and agree that except for advertising programs provided by us, our site and services are available for your personal and non-commercial use only.

You represent, warrant and agree that no materials or content of any kind submitted through your account or otherwise posted, transmitted, or shared by you on our site or through our service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.

As a condition of use, you agree not to use our site or services for any purpose that in unlawful or prohibited by these Terms of Use or any other purpose not reasonably intended by us. A few examples of such limitations are given below:

Upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.

         2. Register for more than one account, register for a account on behalf of an individual other than yourself, or register for a account on behalf of any group or entity.

         3. To abuse, harass, threaten, impersonate or intimidate other Igotdinged users.

         4. If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content and not to violate any laws in your jurisdiction (including but not limited to your local copyright laws).

         5. Upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

         6. To create or submit unwanted email ("Spam") to any other Igotdinged users or any URL;

         7. Upload, post, transmit, share or otherwise make available any material that contains copyright or trademark content or material of any third party other than your own and without obtaining their explicit approval.

         8. To submit stories or comments linking to affiliate programs, copyright work, multi-level marketing schemes, advertisements, sites/blogs repurposing existing stories.

         9. Displays pornographic or sexually explicit material of any kind and in any form.

        10. Provides instructional information about illegal activities such as, but not limited to, making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.

        11. With the intention of artificially inflating or altering the dings or pings count, blog count, comments, or any other Igotdinged service, including by way of creating separate user accounts for the purpose of artificially altering our services; giving or receiving money or other remuneration in exchange for votes; or participating in any other organized effort that in any way artificially alters the results of our services.

        12. To sell or otherwise transfer your profile.

        13. Promotes an illegal and/or unauthorized or pirated copy of another person's copyrighted work (whether marked as such, or not), providing pirated music, video or other pirated Content, or links to such pirated music, video files, or files that contain such other pirated Content.

        14. To violate the rights of any party or that would otherwise create liability or violate any local, state, national or international law.

        15. Upload, post, transmit, share, store or otherwise make available any pictures other than those of a personal nature.

We may remove any Content and accounts at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all.

You are solely responsible for your interactions with other users of the Site. We reserve the right, but have no obligation, to monitor disputes between you and other users.

   5. User content posted on our site  

You understand and agree that you are solely responsible for the any photos, profiles information, messages, links, articles, blogs, discussions and any other content that you upload, publish, display or post on or through our site or its services , or transmit to or share with other users. You may not post, transmit, or share any user content on our site that you did not create or that you do not have permission to post.  

You also understand and agree that Igotdinged may (but is not obligated to) review any content, communication, information, messages, photos, videos, Intellectual Property, material, URLs, profiles and the like that is uploaded, published or displayed on the our site. By posting any content to any area in our site you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the user content on our site. By posting user content to any part of the our site, you automatically grant, and you represent and warrant that you have the right to grant, to Igotdinged an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such user content for any purpose, commercial, advertising, or otherwise, on or in connection with our site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such user content, and to grant and authorize sublicenses of the foregoing. You may remove your user content from our site at any time. If you choose to remove your user content, you acknowledge that the Igotdinged may retain archived copies of your user content.

   6. Copyright Complaints  

We respect the intellectual property rights of others and prohibit our users from uploading, posting or otherwise making any such information available on our site. If you feel that a copyright infringement of your work has happened on our site, please write to us and we will promptly remove or disable access to allegedly infringing material on our site. In case of repeat copyright infringements by a user, we will terminate access for subscribers and account holders who fall under this category. 

   7. Third Party Websites and Content

Certain services in our site may contain links to other websites as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third parties. Because we have no control over such sites and resources, you acknowledge and agree that we are not responsible for availability of such external sites or resources and that we do not endorse not are responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss that may be caused due to use of or reliance on any such content, goods or services available on or through any such site or resource. If you choose to use third party sites, services or resources, you do so at your own risk and you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any site to which you navigate from out site.

   8. Indemnity

You will indemnify and hold harmless Igotdinged, its founders, parents, subsidiaries, affiliates, customers, vendors, officers, contractors and employees from any liability, damage or cost (including reasonable attorneys fees and cost) from (i) any claim or demand made by any third party due to or arising out of your access to our site, use of our site services, violation of our Terms of Use by you, or the infringement by you, or any third party using your account or Igotdinged user-id, of any intellectual property or other right of any person or entity.

We may terminate or suspend any and all Services and your Igotdinged account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You acknowledge that Igotdinged is under no circumstances responsible or liable in any manner for any user generated content, third party material or content posted on our site or in connection with the our services, whether posted or caused by users of our site, by Igotdinged, by third parties or by any of the equipment or programming associated with or utilized in our site or its services. You also understand and agree that we have no control over, and no duty to take any action regarding: which users gain access to our site and its services, what effects the content may have on you, how you may interpret or use our site content, or what actions you may take as a result of having been exposed to that content. We are not responsible for the conduct, whether online or offline, of any user of our site. Our site and services may be temporarily unavailable from time to time for maintenance or other reasons. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. Igotdinged shall not be liable for any failure to perform its obligations. If any provision of the Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable. Both you and us agree that the Terms of Use is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms of Use, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.
